2011 Whitepaper Released by Chinese Supreme People's Court

Thanks to our JMLS LLM '10 graduate, Ms. (Fiona) Yue GAO at King & Wood Mallesons's Shanghai office, who alerted me that the Chinese Supreme People's Court released its 2011 annual report/whitepaper on April 19, 2012 on intellectual property cases before the Court.  The whitepaper is in both Chinese and English with the English version starting from page 25.

Unfortunately, the program is cancelled due to the speaker not receiving timely travel approvals.  We will try to reschedule the program in 2017.

The first specialized IP court in Chinese was established in November of 2014 in Beijing.  Two others were shortly formed in Shanghai and Guangzhou.  These three specialized IP courts have somewhat changed the IP enforcement landscapes for Chinese domestic and foreign IP rights' holders.

TIPS and UPDATES Regarding Chinese Patent Prosecution & Litigation

While the US patent and innovative community is grapping with, and suffering from, the impact of Alice from SCOTUS since 2014, China has also been busy updating and refining its patent law.  Goals to improve utility model patents' quality (through some sort of substantive examination) and strengthening local SIPO enforcement powers are on the agenda, among other things.

Intellectual Property Court in China

President XI Jinping presided over a high level committee meeting on June 6 to decide action items including, among other things, "Framework Opinions of Certain Questions Regarding Pilot Reform of the Judicial System ," "Working Plan For Pilot Judiciary Reform of Shanghai," and "Regarding Working Plan For Establishing an Intellectual Property Court."1  The committee passed motions to approve the three items above and has set subsequent time tables for further implementation details.2 

SIPO Order No. 68 Amending Guidelines for Patent Examination

The State Intellectual Property Office (SIPO) released its Order No. 68 to amend the Guidelines for Patent Examination (equivalent to the MPEP for USPTO) on March 17, 2014 (original text in Chinese here).  The amendments will come into effect on May 1, 2014, same day as the Third Amendments to the Trademark Law.

The amendments are made to the following sections/subsections of the Guidelines for Patent Examination:
