Update on the third amendments to Chinese Trademark Law

As a follow-up to my previous post, the State Council of China has published its draft to the third amendments to the Trademark Law of China on September 2, 2011 seeking comments thereto.  The deadline for submitting the comments has ended on October 8, 2011.  Here are some initial comments to the draft.

2012 is an election year in the US, and it is also a year when Mr. Xi Jinping is expected to become the Premier of China in October or November.  Shuffling and new appointments of key government officials in China is also expected throughout the year.  Whether the new trademark law will become effective this year is yet to be seen, but this is definitely an important event for both lawyers and businesses.  Business activities have evolved drastically since 2001, when the current trademark law was amended, and any updates to the law for the better (depending on your perspective) will help China continue to strengthen its trademark law.
